February 10, 2026 — S.D.N.Y., Judge Rakoff: AI conversations on consumer-tier services are NOT protected by privilege.
In United States v. Heppner, No. 25 Cr. 503 (S.D.N.Y.), the court held that the defendant's use of consumer-tier Claude carried no reasonable expectation of confidentiality — the provider's privacy policy expressly states inputs/outputs may be retained, used for training, and disclosed to third parties including regulators. The same waiver theory applies whenever a user, lawyer, doctor, or banker pastes confidential material into a cloud AI under similar terms.
